1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Mobisthan website, app, and related services (the “Services”), operated by Mobisthan (“Mobisthan,” “we,” “us,” or “our”). By creating an account, browsing, or placing an order on our platform, you agree to be bound by these Terms, our Privacy Policy, our Shipping & Return Policy, and our Warranty Policy. If you do not agree to these Terms, please do not use our Services.

2. Who We Are

Mobisthan operates an e-commerce platform for the sale of refurbished, open box, demo unit, and pre-owned smartphones, tablets, MacBooks, and Windows laptops, along with device repair, trade-in, and subscription services, each backed by our published warranty terms.

3. Eligibility & Accounts

• You must be 18 years or older, or purchasing with the involvement of a parent/guardian, to place an order
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account
• You agree to provide accurate, current, and complete information when creating an account or placing an order
• Mobisthan may suspend or terminate accounts suspected of fraud, abuse, or violation of these Terms

4. Products & Condition Grading

All devices sold on Mobisthan are refurbished, open box, demo unit, or pre-owned, and are graded and described based on their physical and functional condition at the time of listing. Product images are for representation; minor cosmetic variance from the images is possible and, where applicable, is disclosed in the condition grading. Battery health, accessories included, and warranty coverage are as stated on the product page at the time of purchase.

5. Pricing & Payments

• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
• Mobisthan reserves the right to correct pricing errors and to cancel orders placed at an incorrectly listed price, with a full refund
• Payments are processed through third-party payment gateways (including Razorpay); Mobisthan does not store your full card details
• Orders are confirmed only upon successful payment verification

6. Orders, Shipping, Returns & Warranty

Order fulfillment, delivery timelines, cancellations, and returns are governed by our Shipping & Return Policy. Post-purchase warranty coverage for devices and repairs is governed by our Warranty Policy. Both policies form part of these Terms by reference.

7. Trade-In, Repair & Subscription Services

• Trade-in quotes are estimates subject to final physical verification of the device; the final payout may differ from the initial quote if the device's actual condition differs from what was declared
• Repair services carry the warranty terms specified in our Warranty Policy for parts and labor
• Subscription plans renew and bill as described on the plan details page at the time of subscribing; cancellation terms are shown at checkout and in your account dashboard

8. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Submit false, fraudulent, or misleading information (including in trade-in submissions or warranty claims)
• Attempt to gain unauthorized access to our systems, other users' accounts, or non-public areas of the platform
• Post defamatory, abusive, or infringing content in reviews or community areas

9. Intellectual Property

All content on the Mobisthan platform — including the Mobisthan name, logo, product descriptions, graphics, and software — is owned by or licensed to Mobisthan and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Mobisthan's liability for any claim arising from your use of the Services or a product purchased through the platform is limited to the amount paid for the relevant order. Mobisthan is not liable for indirect, incidental, or consequential damages, including loss of data, except where such liability cannot be excluded under applicable Indian consumer protection law.

11. Indemnity

You agree to indemnify and hold Mobisthan harmless from any claims, losses, or damages arising from your violation of these Terms or misuse of the Services.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to your rights under the Consumer Protection Act, 2019 (including the right to approach the appropriate Consumer Disputes Redressal Commission), any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.

13. Changes to These Terms

Mobisthan may update these Terms from time to time to reflect changes in our practices or legal requirements. Material changes will be notified via email, in-app notice, or by updating the “Last Updated” date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
